On Dec 5, 2005 I was rated PPD :) . Saw my doctor on March 2006 for my refill of pain meds. Then moved to another state and haven't seen a doctor yet. My 1st question is will the present a problem with WC as far as not seeing a doctor over a year for pain meds? My 2nd question is if you are in another state, does the IC send you back to NY for an IME if they wish for one? Last question: If the new doctor finds that you have gotten worst and wants you back off work, what does this do about your rating? Does it go back to TPD or does it just say PPD? Thanks for a good web site.

Well, I'm a NY WC person as well (25% PPD). I'm currently residing in another state, though I am close enough to return to NY for medical treatment. When I moved, my attorney did tell me it would be difficult to find a doc who would be willing to take my case on, though it may be possible, if I was able to find a doc here that will accept the IC reimbursement. However, what I ran into was that the "new" physicans wanted to start all over practically....so I would have had to have gone through all the hoops again to get to the same point...ESIs,Facet Block injections, etc, before resuming my current med schedule. That was NOT going to fly with the IC, as they had already paid for those treatments and they were not all that successful. So, with regard to the doc, I think that it is individual, but yes, your IC should cover you, though the year gap may require you to have an IME.

About the IME, I'm not sure, but I would think they have to send you to an IME doc closer to your new home. I haven't had an IME in some time, but I know that when they first sent me for one, I disputed the IME doc selected because he was over 60 miles from my home and I was unable to travel that distance. So, definitely consult with your lawyer about this one.

About the change in your rating, I am not sure how long you have to be out of work because of your health in order to have your case reconsidered and become re-rated. For me, my rating is PPD 25% unless I end up with limb issues and/or paralysis as a result of spinal cord compression. I would think one would have to go through the whole rating process again, with an IME, your doc's evidence and a hearing in front of a judge, if your rating changes with regard to your injury.

Definitely check this stuff out with an attorney. I am by no means an expert in WC law. I can only pass on what my experiences are. My doc in NY continues to provide care for me, because the physicans in this area are not comfortable with the med regimine I am on, or were unable to see me within a reasonable period of time. Hey guys,forgive me for butting in your thread,but I have a NY question.If someone in NY is out on W/C ,is there ever a time when W/c says its time to be evaluated by a W/C Dr.or anyone other than the injured persons Dr.In Fl.the most you can collect is 104 weeks of benefits.After that you would have to ,beyond any doubt prove you are disabled to the point you cant do a thing.Worse than social security.I know a guy up there who claims (he was just in FL on vacation,and I'M NOTpassing judgement,I been on these sites with my issues a long time),as long as his Dr's say he is too disabled to work ,he collects his 400 a week.I got to think some kind of evaluations must take place.Upon reaching my 104th week my atty.got me a settlement to help me through til I hopefully get ssdi.Thanks for any info and hope I didnt offend by cutting in.I will delete if you want me to.

Hi I am a w-c in CA nurse but what I recommend is you call the W-C Board and thet can answer those questions or send you literature to clear it up..Every state is different

in ny the carrier can send you to ime's whenever they want to , as long as they are paying you they can send you to ime's
there is no max number of weeks in ny for ppd and ptd it is until you kick the bucket, if the reason you retire is due to the injury
