I had said earlier that I am gonna make life hard on W/C, you know what is good for the goose is good for the gander. They have made life tough on us.
So this is the letter: I am asking Albert Bett's Commissioner of the Wroker's Compensation within the Texas Department of Insurance, and his staff for assistance in reviewing and responding both to you and this off on the information shared.
This is in response to my email to the Texas Governor and yesterday I mailed to his office a portfolio with about 150 pages in, information covering Traumatic Brain Injury, Eamils good and bad and his complete medical history.
Well boss needs me to do something for him before we leave.

Well we are still in the same limbo as before. Texas Legislature set up what is called An Injuried Workers Council, if you are not in agreement with what the Workman's Comp Carrier has decided and you are unable to resolve the issue they will appoint an Ombudsman to assist you.

We have an Ombudsman he was able to get another designated doctor appointment and now they state that his head, (new), neck, arm, shoulder, and his spine (new) was part of his injury but are still refusing the brain.

I spoke with the Ombudsman last week and for the past month and a half he has been trying to get in touch with the adjuster and just like us has had not luck so he informed me that he will be requesting a Dispute Hearing. So our battle is not over yet. However we have not only the Ombudsman in our corner we also have a great doctor who has seen the improvements.

As far as my husband he is doing much better, by the grace of God he found and awesome Neurologist, he is aware of everything that is going on and he sees James free of charge and gives him all of his meds. Now meds that is another miracle he originally took Clonazepam twice a day, now with that he takes Lamictal and he is functioning great. He is unable to work, leaving the house stresses him out and he still gets disoriented when away from familiar areas but he is functioning so well.

The only thing that we have ever asked for was to see a doctor qualified to determined if his brain suffered an additional injury. It saddens me to think that if they had not stopped his appointment to the neurophysiologist in September 06 would he have been able to return to work by now, I guess we will never know. I just know that by him not receiving the proper medical treatment his brain suffered unnecessary seizures for over a year.

However he is working on building our house (he was a bricklayer) he does not do this alone I work for a carpentry company and the guys go out and work and then they leave him with things to do, I cry when I see it, they make him use his mind more working with numbers and his hands, right now he is receiving the best physical therapy possible, it is still rough. Yesterday he told me he no longer wishes he would just die, he said that now that Dr. Leder is in his life that he actually wants to continue living.

Been a rough two years but there is a light at the end of the tunnel.

On July 29th we go before the Review Board, I am just so tired, but I cannt let this go it has taken my husband freedom and independence away from him, let alone our income. All he wants is to return to work and support his family, this wont ever happen. Now he is starting to look back at notes and stuff and he cannt believe that this all about him, he asked me this morning "Where was I during all of this"

Had to postpone our hearing, hubby's neuro was out of town and we needed some documentation for him. Oh yeah it was so worth the wait. We now have a specialist that agrees with us, all they have is their designated dr who is not qualified to determine a brain injury.

To Read the designated dr report he dances all around the brain but excludes the brain, covers all of the functions of the brain but states that the brain is not includes things like short term memory is included and cognition is covered, speech and balance is to be covered but not the brain. What kind of moroons do they employee?

I just get so frustrated with all of this.
