I've allways heard they will penalize you...You will get less back pay,,If any..Depends on how much monies you get,,If it's a large amount,,You may not get any backpay at all,,Now I'n not 100 % sure,,I was allways told do one at a time..Do the wc claim then when that is finished...Start the SSDI..Thats the only way you'll win..Sorry if I have this wrong, But no one else seemed to answer...Cindy

Your SSDI is not affected by income or resources, only SSI is, so I would think that if you are receiving SSDI and not SSI, it wouldn't affect anything, but I don't know for sure. If you are receiving both SSDI and SSI, it would affect only the SSI. I THINK.

I received some inheritance money last month, and it had NO AFFECT on my SSDI. And I'm making too much from SSDI to qualify for SSI, so that money did not affect anything for me. I would think that money from WC would be the same.

Good luck, but I would suggest calling your local SSA office, or the 800 number and find out for sure.

I didn't understand, If you have allready got your SSDI settled..Then it should not affect nothing...Fight for every right you got...Get you an attorney and don't sttle for nothing but what you deserve..I thought you were trying to get both at the same time,,,Which is a big NO No

Not sure if this is gonna help but this is what we were told, he received his SSDI, and it starts this month, receiving 1st check in February.
He now gets a WC weekly benefit check, she said that everything he receives from WC before January 1, does not count, he keeps it all, but he has to call them now and let them know how much he is receiving. What happens now I am not sure but when I find out I will update!

ssdi allows you to receive up to 80% of your average weekly wage( or whatever ssdi calls it) with your combined income of wc and ssdi.
after 80 % you get your ssdi offset.
if your looking at receiving ssdi and wc settlement that becomes a whole different set of issues. there is a Medicare set aside required.

Not sure but I am on STD and after 6 months I have to file SSDI and back pay would have to go to disability Company unless it is more than I recieved.

in this case ssdi will not lower your wages your std turns to ltd and LTD will want the any monies that equalled more than 50% of your salary

in my state you don't have to settle , so it is not worth it to me, settlements are usually only 5 to 8 years of your payments, and than you need to take part of that money and out in it a medicare set aside, that you can only spend on your wc medical care.
