Hope everyone made it through the holidays. Where do I start with this one, I guess it just depends on where I want it to go--right??
Hubby was approved in about three months for his Social Security Disability, everyones tells me that is great, however they would not be saying that if they would just stop for a minute and think about how he got approved so quickly and why he was approved.
Most of you are aware of his story for as I been here on BT every since he was diagnosised with a pineal cyst back in Oct 05. The cyst was discovered by accident when they were doing a CT, he had a roller skating accident & was in the ER for 18 stitches under the right eye and 8 in the lip, he kept asking the same questions over and over again so they ordered a CT. No hydrocephalus present at that time but when the follow up MRI was done 5 days later he had developed hydro. We left Houston and went to New York City to have a 20 minute brains procedure done to help with the hydro.
Life is good, he goes back to work, but no one takes into consideration that he is going back into a very violent situation, and his brain has only begun to heal. Healing not only from a concussion but also brain surgery. Over the next 7 months he is involved in at least 4 physical altercation. Lets see: 1) he goes down 4 concrete steps to the asphalt with a student, 2)He is slugged in the face, grabbed by the throat and falls to the ground with a student (this was the second fight that day, so lets make this one number 4)He goes over a desk with a student. Going over the desk was the last straw for his brain it shut down on him.
So this brings us to where we are today, Workman's Comp is saying well on the fight number 2 we will cover his neck, his right shoulder and his right arm but we will not cover the brain his brain condition was pre existing. Well they are right in a way it was already there, however all MRI's reports state that his pineal cyst and his hydro is stable and unchanged, has had three of them done 12-9-05, 4-28-06 & 8-10-06. This just proves how ignorant our health care system is, and thanks to Mr Kevin Jackson, this high school graduate has been doing her research which can put my hubby's d*mn attorney to shame. She keeps telling me some sh*t like I am the judicial side not the medical side and I dont want to hear the medical side. Well that is not getting us anywhere and if she would just read some of the medical stuff she would see the insurance adjuster herself laid it all at there for her.
I know I should have researched this earlier but I thought (dummy me) her have a legal degree would give her an advantage over me but people where blinders when it comes to TBI. Whiplash can cause a Mild TBI, well they treated hubby for whiplash, so how can they say a brain that is still recovering from a TBI did not receive another one with this violent fight he was in (the boys went back to jail and felony assault charges were filed against them). How can they say this because as smart as they think they are they do not no squat about brains and they have one. Time they learn about it though. Well they sent us a letter denying our appeal because our attorney did not have sufficient medical evidence and it was evident that our attorney only filed the papers to stay within her 90 day time frame. We have never asked for weekly benefit checks or a lump sum payout all we have asked for is to see the Neurophysiologist that was trying to make my husband's original appointment back in September when all of a suddent the WC adjuster said that his brain injury was not related to the fights, how in the h*ll do they know this, they did not let him go to the right doctor they only let him see a general practiciner, the neurologist would not even see him she said he needs the neurophysiologist, well they cannot determine whether it is a brain injury unless they allow him to go to this doctor, this doctor is the one that can determine this.
Not cutting it with me, if they want evidence then this old country girl is gonna give them more information than they can imagine and I am not stopping with the Insurance Moroons I am sending his story out to every Congressman and every Senator I can find an address to. I have got allot of data gathered together, gonna start putting it in a binder format and I am off to war. By the way I emailed Governor Rick Perry yesterday, I did not drive all the way from Houston TX to New York City NY to a strange place and a doctor I had never met for no reason. I took my husband there for a minimal as possible invasive surgery so his life could be as normal as possible to just sit back and let his job take everything away from him.
After typing this I had to change the title of my thread!
