Hi

I am back after a long time.I have rsd.I am in Illinois. I didnt have a very good attorney.I settled before the arbitrator last Aug. for a small amount but I did get open medical so my lawyer said.

I am getting much worse,now I have horrible migraines as well as pain all up my arm,in my wrist.I kept calling and emailing my lawyer.He didnt return calls or answer emails. I finally was so desperate I called wc.I fired my attorney.He did get letter,was sent by certified mail,rr requested.Anyhow they authorized me to see dr in Mo. and said to call when I got back.They told me if he says I have rsd they will not pay for any further treatment,it was not my prognosis.I told them Id had this all along.My hand is withering away to nothing as the dr. says,horrible pain.Now wc will not return calls,Ive called twice.I cannot afford to buy medicine out of my pocket.I am unable to work. I do not know why my lawyer did not tell me about this stipulation to the open medical. No wonder they offered it.I wasnt going to get any treatment anyhow. I think I should have been told.I am just sick.I cried all yesterday morning as I have no money,no job, no husband or boyfriend or family to help me. I live off of a small pension.I cannot believe anybody could be so cruel and so low down to do a person this way.

Also,am I entitled to my file from my lawyer. Would I have to pay a fee to get it.I want to see correspondance between he and wc.I doubt there was much.

Does anyone have any advice. I didnt ever dream workers comp would stoop so low and my lawyer is right with them.I am totally devistated beyond words.

Thank you for any advice .I am very desperate and very depressed over what I went through this week.

Yes we have all come to learn that worker's compensation is a joke, they scam you every way they can. In Texas we have The Office of Injured Workers Council and the appointment and Ombudsman to assist you if you do not have an attorney. We had one, she was in for her cut of the money, not for the medical assistance my husband needed. I found this online for Illinois, this would be a great place for you to start. YOU are your best defense right now.

yes you are entitled to your legal file after you have dismissed your atty.
let them know when you'll be in their office to pick it up and there should be no fee.
You should interview a number of new attys before selecting a replacement.

There are various local WC support groups. See if there is one in your area. When interviewing the attorneys have each write up a plan of action for your case.

Thanks to all for the advice.I have never heard of a workers comp support group.I am in Illinois.I really appreciate the replies to try to help me.I am 60 and almost too tired to try to fight wc but I will have to

What I was wondering is this....my case has been reopened.I fired my lawyer and he hasnt done anything for me since I settled before the arbitrator over a year ago.I wouldnt think he is entitled to anything from the case being reopened. If I get a new attorney wont he get the money if I get another settlement since I am getting worse?My old attorney told me I can get another settlement.Since I have rsd I am only continuing to get worse.I know thats why wc dont want to claim the rsd.Does anyone know.I have got to find me an attorney who is familiar with rsd.

the judge has to approve any atty and if there is a dispute between attys will decide how much each gets. the new atty will notify the court and the prior atty of the change.

Hi

I have a form I printed from the computer that I have to fill out to give or send to the arbitrator to see if she will let me get rid of the last attorney.My case has been reopened but workers comp wont acknowledge the rsd. Im not sure what they think I have or why they think my hand is shriveling up.I am so disgusted.I really need to get busy and try to find me an attorney .I have to have one that knows about rsd.

Since my case is reopened then I suppose the old attorney wont get a thing,just the new attorney.I mean if I keep getting worse.Which with rsd Im sure I will.
