View Full Version : Is "Poor Leadership" a reason for dismissal?

Hello,

My name is Vicky and my ex-husband has been having panic attacks for almost five years, intermittantly. He is 52 years old and is an Information Manager who makes in the 3 figures at his job. After he was released from the hospital after suffering his last set of panic attacks, his boss put him on a 60 day probationary period because his boss says he lacks leadership skills.

My question is should he wait until he is fired and then sue the company for firing him without reasonable cause or should he threaten a law suit before that happens to have the suspension wiped clean from his record.

If he is a manager and they can prove that he has "poor leadership" skills they may have a case. I am guessing you are in the US If so to file a complaint you have to go through the Equal Employment Opportunities Commission to sue and I have been trying to get them to take my case for 2 years. I was let go because "having a seizure at work may scare my co-workers" I have a lawyer from my church helping me probono but he has warned me that the EEOC is very, very, very employer sided. People with disabilities do not have a fighting chance. In order to get a lawyer that you will pay for be prepared to spend several thousand dollars upfront. Lawyers know these cases are nearly impossible to win so they will not take them on contingincy basis. Sorry for being so negative but I want you to know what you are facing Annmarie

Thanks Anna Marie. I don'tt think he would hire an attorney to fight anyway. He gives up very easily. I wish he had your spunk!

You don't say where you live but the laws differ a bit from state to state.
