View Full Version : YAY! nice to be back..but in pain

:) hello friends..I was josmeg on here back in the day....I had 2 surgeries..within the last yr and a half....Was doing pretty good, occasional discomfort but able to make it, even went back to my job as a nurse with hospice.... anyways, a month ago, I slipped in a wet spot at Walmart and slipped but was able top catch myself..no wet floor sign, and the greeter saw it happen and was telling me to have a good night...I felt pain, but figured it was a pulled muscle..decided to file a claim.The cls representative stated that Walmart said they were neglagent and had it on tape and all that..My problem is, they want me to pay for all of my Dr bills upfront and then pay me back at the end of treatments...Well, I just lost my insurance due to my husband having a heart attack/pacemaker/ and in need of a new heart.Right now, I am his caretaker, hes doing pretty good, but we couldnt afford the Cobra for the family, so we just kept him on it..So, that means I am uninsured and darn sure cant afford to see my neuro or the facility that did my 2 prior surgeries..So, this past week, I been in real bad pain, cant sleep etc...I begged the claims adjuster to put up the $$ for my Dr visits, but they wont.They offered me $4,000 today and really, thats a insult.So, if I have the MRI, Dr consult and more diagnostic testing and they find something wrong, I would be responsible AFTER they pay for those tests.My l5 S1 surgical site is what kills me.I have different type of pain this time around.Cannot sit on a toilet too long, cant sit at all..ice, heat, Motrin hasnt helped much.I am at a loss..I havent gone to the ER cause I know how they do with back pain, but its really getting bad and I have a feeling the areas I had surgery on and fixed are messed up again. I did go to a clinic a week after and they said it was a pulled muscle, but I beg to differ..I know the difference...So, does anyone have any ideas on how I should handle this?I am really wanting to keep a lawyer out of it...All I want is to get fixed what got messed up..is that too much to ask? I am thinking so....:( :confused:

You find an accident attorney. You tell him your story. He gets a copy of the tape they have admitted they have.

Then you will know if you have a case. If you do you'll be suprised that the money will start flowing.

If not then you do what the rest of us who do not have insurance do. You suffer. You take as many warm baths as you can. You go to massage, you do whatever you can find a way to pay for.

This is the harsh reality of life.

But a good attorney will help you. Don't waste anytime in finding one. Don't accept any money now. It could be an admission on your part of a "settlement". Leave the law to the lawyers.

Get the attorney first and then follow their advice. You won't have a problem finding an attorney to take an accident case against a big box retailer. But known your past history they are going to pin the blame on you and your pre existing condition.

It isn't going to be fun.

I seldom agree with lawsuits. This time, taking everything as you have described I would say they need to pay your medical bills. The reason they have a policy of repayment is so people don't take advantage of the situation. Far too often that's what people have done. Also I have no doubt it helps limit how much gets spent. If people just have a blank check they get anything and everything done even if it's unrelated.

yeah, Jolene, I can see someone taking advantage..and everything is about money...I would like my Dr to do what he has to do, see whatever damage has occured, have the tests to prove, then let the Dr get paid for what he has done..but.. they wont do it that way..and I am not taking any $$ from the adjuster and be swepted under the rug....
