View Full Version : Does Workers' Comp have to back pay

If the insurance drs rate your disability at a lower rate but it's been show by other drs that it is 100 and perm. does the workers comp have to back pay from the time the weekly amount was reduced or should SSD may up the difference. I haven't told SS cause I don't want to have to pay them back, but I need to know which way to go with this cause now the insurance company wants to settle but hasn't made a financial offer a 32 settlement.

Bitzer I am still battling worker's comp for hubby so I am answering as to my understanding from what the Ombudsman told us. I may be wrong but this was my understanding. That when we win (not if) they will have to go back to the original date of injury and pay all past amounts. My husband has been receiving Social Security Disability payments since January 2007, this is my understanding, Worker's Comp will have to go back and reimburse Social Security for everything that he has been paid, and it DOES NOT come out of his pay. That the carrier is responsible for repayment.


I may be wrong but this is what I have been lead to believe.

this is an old post but even though Bitzer may not be checking for a response others may see and return to this board.

Once a decision on the amount of disability is made there will be retroactive payments.
