I've been checking this out for a while I guess no one needs or wants to post on here any more but then again I understand why.
I've been dealing with workers' comp for over 10 years and even though this web site says I'm new I'm not. But I keep checking on here to see what's new hoping some one post new info for workers' comp especially for New York.
I'm very disappointed in the system and with my attorneys but to change attorneys this late in the game worries me, I feel attorneys know each other and if you complain about one the word gets passed around and then you get even less help with your fight and it is a fight.
My attorney said the insurance company wants to settle but the settlement sucks but she gave me the feeling she wanted me to take it so she can be done with the case cause it's no longer new or big because of her not the medical end of it. I've settled to the point I'm not going to get better but my body will get worse and so will the pain.
But if your attorney doesn't want to fight the good fight all you have left is your doctor who will take care of you no matter what workers' comp does and at least I have that. He listens and does what he can. But if your attorney doesn't keep your case current it gets put on the back burner.
I had a hearing almost a year ago and an appeal put in in June, but I compared the appeal my attorney put in to the appeal from a few years ago and the difference in the passion shows she has lost interest to the point she doesn't even return phone calls.
I guess this is the point where you give up or give in and just settle cause fighting this battle alone is to hard you need legal support and medical support not just one but both.
I guess I needed to vent cause other than my husband and my doctor who are limited as to want they can do it really is a legal battle that requires a passionate attorney who really cares and it shouldn't matter how big the money is but that the client gets your best. Would I like to send a copy of this to my attorney sure I would but I think it would make this worse.
Here's to the ones who can get an attorney who has passion, common sense and cares about their clients, they are rare and you as the client should let them know how much you appreciate their hard work.
As for workers' comp and New State WC Board you all suck. But I save everything and hopefully one day I'll get a chance to show how little my attorney did and what the insurance company didn't do.
