View Full Version : TOTALLY ANNOYED... to say the least!

Venting here, my hubby is tired of hearing it!
After three years of being denied by SSD, I finally had my hearing with the judge. My attorney brought (and gave the judge) over sixty pages of reports and records... MRI reports, CT scan reports, surgery reports, pain med doc reports, neurosurgeon records and medical status, and so on.
The "Vocational Expert" stated that I could work for about 20 minutes sitting and then would need about five minutes to stand/walk/stretch. I can't sit in one position for 20 minutes, let alone work a two hour day! If I sit for two hours I have to lay down for the rest of the day. They went through "6 different hypothetical persons", and then told me that the judge would make his decision and let me know.
My attorney was baffled and so was and am I. This was supposed to be a SOLID case, basically open and shut.
There was a woman, putting on a good act in the waiting room, talking with her attorney. She hadn't had a surgery, was on pain meds and muscle relaxers and didn't plan on having a surgery. She was in with her judge for about 15 minutes and they approved her. It just baffles me that she was approved and they are going to review all my stuff. Along with everything in my signature below I also have failed back surgey syndrome.
Just don't understand the system, and am tottally MAD... to say the least.
Sorry about venting so much, but I am sure there are many others going through the same thing. Oh, and the judge was soooo nice, he said "I hope your back gets better". HA!:mad:

I can totally understand where you are coming from.. I couldnt even stand or sit THRU the hearing. I had to keep getting up and sitting down thru that short hearing. My attorney described about my pain and my incontinence (bladder and bowel) and the loads of doctors I see and the judge saw I was using a rollator walker and YET they denied me (it took a YEAR for him to send me his denial) :eek: :mad: :mad: .. I've been at this for 6 YEARS (in Dec).. I PRAYYYYYYYYYYYYYYY that your judge WILLLLLLLL see it NOW and approve it NOW and you will hear ASAP . I dont want ANYONE to go thru what I've gone thru. Its ridiculous. My back surgeon told me today that I WILL eventually need surgery and he is thinking now because is gotten worse but Im holding off because Im a single mom of 4 boys.

Hi my name is Brian and I am trying to get disability also. I know what you mean when you see people getting approved and you wonder why not me. I personally know two people with nothing physically wrong with them but because they are supposed to be bi polor or depressed they got it the first time yet we are basically crippled to some extent and they dont approve us. I tried working for almost 16 years and because of a failed fusion with hardware broken I had to have another 360 spine fusion from t5 to my pelvis with two brand new harrington rods and two pedicle screws. I have been on Avinza 90mg which is Morphine for the last four years until yesterday when the doctor switched me to the Duragesic Patch 50mcg because of swelling in my legs and increased pain. I have a entire book full of medical records from Orthopeadic surgeons, urologist, primary care doctor, and pulmonary doctors. I work at a computer and sitting all day is killing me. I have no life other than going to work and coming home and going to bed. The problem I have is I am only 35, educated and both of those things are held against me. I applied in Sept but I havent heard anything yet. Since applying I have had a Cystiotomy and dialation because of an urethral stricture and now I need my entire urethra reconstructed and just two weeks ago I had Carpel tunnel release also. I figured after three spine fusions and a failed fusion I would have not trouble getting on but like you I am still waiting. I was born with problems as you will see in my signature and I have also been in three major car accidents with broken bones and coma. I will pray you get your positive decision soon. I know how hard it is to live in pain and also have some judge criticize you for not being able to work. Did the judge even look at any xrays you had. I was told the disablity office would not accept xrays because they are not doctors. I then thought well how can they say I am not disabled if they are not doctors. I was told they read the doctors reports and make a decision. I swear if the judge or whomever saw my xrays and six scars where they litterally cut me in half they would know I could no longer work. I guess we are going to have to say we are mentally sick to get on disablity. I also get so mad at how our government doesnt mind helping out illegals who come to our country for a hand out or people who suck off the welfare system from cradle to grave without doing a days work. Anyway I will close this post before I get kicked out of here. Finally one last thing to Gina, before you have spine fusion please make sure your doctor can actually help your pain because after my surgery I ended up with more pain than before. Good Luck, Brian

yeap i have been fighting for 6 years. of course i think mine is more due to a incomptant attorney then anything.
it bothers me that they do there best to deny as many people as they can for as long as they can.
heck my doctors are amazed i have not got it. they have said they have seen people with far less get it.
just annoying. many who really need it are put off for years.

Who was the Vocational Expert representing? I mean, did your lawyer hire him to evaluate you or was it a Government Vocational Expert for SSDI?

Hello, the Vocational Expert was a Government Vocational Expert for SSDI. I just wanted to slap that guy. He was kind of arrogant (go figure!), and he said that it would be totally acceptable for an employee to be absent one day a month due to my disability(per employer statement). My attorney asked him when the last time he spoke to an employer about this matter, and the VE said "oh a month ago." My attorney then said, "well what if the emloyee gets sick with a cold or flu and has to take two days off a month, is that acceptable?" He said "NO". I still haven't received anything from the judge, and don't expect anything for quite some time.
Brian ~ I am figuring that they will deny me because I am only 37, educated and have skills. And I think it is absolutey DISGUSTING that they have denied you. I also can't believe that you are still working! Work and sleep... what a life. I sit/lay all day long except for taking and picking my daughter up from school, and grocery shopping with my 16 year old son, who gets everything for me... all I do at the store is point something out and pay for it; my son does all the rest. He also does most of the cooking and cleaning in the kitchen! Good kid! My daughter helps me with the laundry... she carries it in and out. I am lucky in that sense.
Gina Marie ~ I agree with Brian totally; make sure that you have an excellent orthopaedic or neurosurgeon before you have the surgery, like Brian I am in more pain now after two surgeries and another one on the way!

i apply back in 04/ and had my hearing in sept 06 ,called in oct /called in nov/ nov i was told they mail the judge deccison out on nov 2. okay then was told they closed it on nov 7. they said they mail it out when they close it on the 7th called yesterday and they said ,it takes the mail 2 weeks to get from down town to me not so far from down town any way called lawyer and my lawyer said he can't tell me nothing ,he is waiting like me .do you know i only spend two days with my lawyer through all this, that is at the begining and at the end, i do know that at the end of my hearing the vocational expert saic he couln't find no work i could do and my lawyer OPEN his mouth then :rolleyes: and begin to say my doctor said i can't sit more than 30min would have to take unshedule breaks every 15min ,get up walk around and miss more than 4 days of work a month therefore qualify her to be disable and the judge said right infront of me and him that he agree with everything he just said ,the only thing the judge didnot agree with was my lawyer called my doctor a neurosurgeon and he is a neuroligist dose this mean i am approved ,because my lawyer is saying he don't no nothing:confused:
