I have been on WC since Sept. 28, 2007. Everything has been going good up until we filed suit last month. They cut everything check and medical. This is a Jones Act case. What happens next? have not been able to talk to the lawer yet, not till monday. CAN THEY JUST CUT IT ALL OFF NOW?

:eek:I am really sorry you are dealing with workman's comp, but yes they can do anything they durn well please. Yeah it sucks but they have the ball in their court. They put a stop to my hubby even going to a doctor to determine if he had had an injury (his was a secondary brain injury). They did pay for his prescripts until December 2007. Yeah they paid all right as long as he was on Vicodin and Tramadol but once we found real meds that worked and not just covered everything up then all of a sudden they stopped.

We cannt even find an attorney to take our case, luckily here in Texas their is an agency set up by the state called the "Injured Workers Council" we have been appointed an Ombudsman, if you are not legally represented then they will assist you.

I am truly sorry but WC is a battle and can be a long hard battle, if you were injured on your job then dont give up, keep up the fight. They hope that you will just shut up and go away.:)

Trust me I have been dealing with it since August 2006. Just dont let important dates pass by, keep it active, and if all else fells do as I did I wrote my Governor not just once either I wrote to him twice.

The thing with W/C is that they are fighting over is how the case was filed. If they win they still owe me the checks and medical. if we win they still owe us the same amount. The Lawyer Says that they may have to pay us more either way. The fight is if this falls under the Jones Act or Harbor Works and Longshoresmen Act.

Its just a retailation likely,of course the judge will reinstate the benefits,but in the meantime they use whatever they can to get you to cave ,if you will.DONT.What state are you in.That may help for info.But I understand the Jones act is federal,so,Im not sure if the state W/C laws apply.

IM in Louisiana, I believe Jones Act and Harbor Works and Longshoresmen Act are both federal.

The main thing zippie no matter what keep the fight going, keep deadlines. They hope we get weak and go away so they can keep their precious money. Just keep your chin up and know you have a world of support. We may not have all the answers but we sure got broad shoulders and good ears.

This is typical. They are trying to starve you out. You just have to hang in there. There used to be a list of resources for people. You might do a search. I've survived 14 years of wc crap and am still fighting them. I'd rather die then give up.

Amen Disabled I refuse to give up and it is not even me that is injuried.

Keep up the fight, dont let them when, they are paid well.
