yesterday my husband's former employer called and informed us that they are cancelling his COBRA coverage as of Sept 15th. because they are changing insurance plans.

is this legal?? he has 18 months of COBRA that are available to him and now they just want to CANCEL it??

i mean, he HAS a job now, but its gonna be three months til he gets new insurance, maybe longer if the company decides to keep him on contract longer than three months. and i would LOVE not having to write that check every month.

BUT...

he still needs that COBRA until he gets new insurance.


is this legal for them to do?? it is a small company but i just dont think this is right!!

Hello Servo and all Braintalk Community Members. First let me say I'm not totally positive but I'm pretty sure that if your a full time employee already on the Cobra Plan, you must be kept on "A Plan," that will cover the balance of time you have left at the point of change. As an employer myself years ago, I know you must accomadate your employee to all entitled. In fact, just prior to the time I acquired my current chronic illness of Central Pontine Myelinolysis, I was on my Cobra plan as I as approved for GBS. (Gastric Bypass Surgery/Bariatric Surgery) As it was Social Security Disability who then made my award on the date of post-op day one, I was then cleared at the age of 51 to be admitted right from my Cobra Plan directly to Medicare which I also used AARP as my back up. You may have to make a few calls to the different government offices but in NO way would I accept an answer such as you recieved. "Nobody takes better care of you and yours than you and yours." When we changed insurance our Cobra people were given the option to switch to the new coverage.
