Just now getting back to this forum - After 3 years I finally got a favorable decision from the ALJ... he said the following
Considering the evidence of record, I find that the claimant’s medically determinable impairments could reasonably be accepted to produce the alleged symptoms and that the claimant’s statements concerning the intensity, persistence and limiting effects of theses symptoms are generally credible.
The state agency consultants did not consider all of the claimant's impairments contained in the medical evidence of the record. Moreover, the state agnecy consultants failed to consider the combined effect of all the claimants impairments as required by the regulations. Furthermore, the state agency did not adequately consider the entire record, including the statements of collateral sources as well as the subjective complaints and other allegations of the claimant.
I was very impressed with this ALJ - for the record I have Adhesive Arachnoiditis produced by a surgeon running a pedical screw in to my spinal canal and damaging my nerves at the l3/l4 level - which has now radiated down in to the lower levels making it almost impossible for me to do anything due to pain... but the SSD office thought I had a fusion, and was all hunky dorry...
