View Full Version : LTD hire PI,have me tape, and YES,it was a 3hr INTERVIEW!!

LTD HIRED A PRIVATE INVESTIGATOR- I am sick to my stomach,unbelievable!!.....ALL because my PM didn't fill out all of the LTD forms!!......so, they hired a PI, have me on tape 3times, only one time i'm worried about (they caught me picking up my 2yr.old)....almost all the film correleated with my interview, but still i am nauseated....
LTD pays me $100/month...if i get cancelled, what will SSD do when i go up for renewal june'07? Isn't there a place where SSD asks this info???
I am just ssssoooo sick of this all...
I would give anything to be able to work and be healthy again!

they taped only this session in your home? or are you saying unbenonst to you they have been taping from outside your house of following to the store?
if only this one time they were taping inside your house, i don't know if i would worry about it.
in the future , if there is a future you know now to refuse to meet them in your home and refuse to be taped.

they hired a PI to film me outside of my home. Once i went to the dr.s', once i went to Walgreens, and the last time i went to the beach playground with my son. I walked to the beach, they caught me in my bathing suit,and everything...but they missed the part where my 2yr old accidentally pulled my top down(or the PI kept it himself)...
I was honest, and everything matched. I have nothing to hide, except the worry, that yes, to the normal person, i may 'look' normal for 2-3hrs...what they don't see is how long i have to lay down or rest after doing anything.

How did you find out they video taped you? Did they tell you this at your interview? I just think it's criminal to tape someone in a situation that does not show a person is able to work in a sustained position 8 hours a day, 5 days a week. Just because you come home from the store and can not keep your perishables in the car. I'm unable to do a lot, but if I pick up a few things at the store. I can not wait for some one to come home to bring up the meat and milk. Being at the beach in a bathing suit does not mean you can work 40 hours a week. These PI's are as low as someone can get. Did they tell you they were denying your benefits because of these tapes?

At the end of the agonizing 3hr interview the interviewer said, "Oh,and btw, I hired a Private Investigator on you. Here is the video"-He showed the whole thing to me.

Unfortunately what happened to you is quite common when dealing with LTD.
If you are denied further LTD benefits and decide to appeal that denial, you can challenge the footage that was captured in the videos especially if you feel you weren't doing anything against your restrictions.
Your doctor can also refute those findings to help you keep your benefits intact, hopefully your PM will now complete the forms the LTD carrier was requesting.
You will have a chance to explain, don't let them win, that is exactly what they are counting on.
I'm also on LTD (currently appealing but not due to surveillance) and recently completed my SSD review and was reapproved, the forms I had to complete did not inquire about LTD benefits, so I would assume you have nothing to worry about there.
I don't think collecting LTD is much of a concern to SSD, the main reason SSD is so important to the LTD carrier is so they can offset what SSD pays you, not vice versa. (Assuming you are on SSD and not SSI)

bg2006 have good suggestion,
don't fold since they show you the tapes, your doctor may very well say there was nothing wrong with what you were doing.
they may be trying tio scare you, so that you don't appeal the loss of benefits.

Yonkersguy is correct, they are trying to scare you, more times than not people just give up the fight, that is what they are counting on and why they use the tactics they do.
I've had my benefits stopped and reinstated after appeals on more than one occasion always for some BS reason, which is why I believe it's always in ones best interest to fight back and give them a taste of their own medicine.
The LTD carriers usually start giving claimants a hard time around the two year mark of receiving benefts (normally when they are doing a review for continued benefits if a policy switches from your own occupation at the time of filing, over to any occupation) the nightmare usually begins at the any occupation stage.
If one needs to appeal a denial, please pay very close attention to the time limits you have for the appeal so that you don't lose out on any of your rights.

First ,The SSDI part.The SSA must put forth the evidence ,just like you did in the beginning to get the SSDI,to prove BEYOND any DOUBT that you have rehabilitated to the point that you are now able to work. Meaning they must have Drs. prove that you Drs. are NOW wrong. As long as you continue to see your Dr.Often? just how often is ??? ,are you still taking meds for your condition ?If you arent seeing the Dr. I suggest you do ,keeping your case ongoing. You can't just stop being treated after awarded SSDI,thats part of the review process,to see where you are in your health.I could be wrong here but I would think the SSA knows these PI's are hired to find you doing something that you basically say you CANT do. Such as lifting up X amount of lbs. of weight. Then in a position of being motherly ,you out of concern for yourself tend to your child.I have read some online info that I hope helps.Most of these vidio's get thrown out. Especially if they are cut up.If you have an atty. be sure to mention it,I hope you do have an atty. because it has been proven that ,even with their fees ,they can get you more money and better service.Bottom line is, don't panic, all these vidios can be beaten,a few minutes of care of your child does not mean that 8 hrs a day you can lift these weights at work. But be careful,the less they have the better,but an atty. can order to see the tapes and build a case against anything they show.See your Dr. often as you can and refill the meds .

I dont understand why they would hassle someone with your disabilities. Do they honestly think you can work with your disablities that you have documented? I hate hearing how our government continues to hassle sick people but yet they dont have any problem giving money away to illegals who enter our country or people who stay home on their butts while getting money for having babies when they have no documented medical problems. I applied for disability a few months ago and I am still waiting. My medical records are too heavy for me to lift but I havent heard a word from them yet. Brian

I dont understand how the ssd works myself. I have seen people on it that I wonder how they even get it,especially people better off than my son who drive and live on their own,yet they get disability for mental problems.I do know people though that truly deserve it and get it.I really dont think its fair how they spy on people and tape them and I have heard they redo the tapes and leave some of the stuff out to make them look better to get a persons disabilty denied.And when a person is in so much pain or on medication how do they expect them to get out and work is beyond me. There is lots of things not fair that I see going on. I see things all the time that I just dont understand. I hope everyone gets the disabilty they deserve. I am sure eventually with this crippled up arm I will apply for it. I dont know who will hire me like this.Mine is workers comp.I havent settled but I dont have money coming in.my lawyer hasnt even tried to get me benefits from workers comp each week. All he wants to do is settle. Life isnt easy when you spend each day in pain. Angel 1954
