View Full Version : Question about CDR's and Diary Dates

I have a friend who was approved for benefits at the first level, at age 49. She was put in the "MIP" catagory, with a 3 year diary. She assumed that she would be reviewed every 3 years until age 65. However, another friend who used to work at SSA told her that when she reached the "advanced age" of 55, her diary interval will almost for sure be increased to 7 years. I gather this is because statistically speaking, very few "productive" CDR's are done on people 55 and older. I have not seen this particular question addressed on this forum.

I would appreciate any information concerning this from anyone who knows more about it than I do...... :-)

I'd be interested in this questions answer too, as from what I'm able to gather, my CDR would be at 3 years as well, as I just recently received a favorable decision at the ALJ Level (received the "approval" letter from the Judge's office at just under two weeks, but no "notice of award" yet...).

I'll also be over age 55 by that time too, so curiosity abounds...;)

Hey, folks. I hate to rain on your parade, but I've had two CDR reviews on a three-year calendar since I turned 55. And that's despite a code number indicating I have little chance of improvement. I was approved three months after my first application, with no legal assistance.

I will say this, though. Both CDR's sailed through with only the six-question short form.

Hello BD. Thanks for your reply. I haven't been able to find any information on this, so apparently once a 3 year diary is set, it is permanent. It does seem like a waste of time and resources for SSA to continue to review elderly people every 3 years who have been disabled for a long time.

Hi Daisygirl,

The rules apply differently for short-form quick reviews vs. full medical re-examinations as far as setting future diaries goes. A short-form review is not considered a full medical review, but rather a postponement of a medical review to a future date. The rule for short-form reviews that are "postponed into the future" is to simply use the type of diary already established, even if someone is now over age 55.

On the other hand, if someone has a full medical review, and is continued for benefits, that action is considered a new decision (not just a postponement of review to the future). A person who is over age 51 1/2 at the time of the review decision would most likely get a 7-year review diary.
