I just wonder what you mean by before or after surgery as I'm in the same situation as you. W/C wants me to do the surgery in 30 days or settle for very little and close medical.

Been on SSDI and W/C for 10 yrs and finally get surgery approved but both doctor and W/C pushing real hard for the surgery my attorney says don't do it but I need to get them out of my life. Nobody can answer questions.

Last time I talked to my attorney she was talking about nail polish with asst. why she trying to talk to me.

Each case is different and so are laws for every state.I'll take a shot here with a guess.If you have surgery,it's possible you will recover somewhat ,thus lowering your disability %.If that is the case,your settlement,if any ,may be lower.Reason for that could be,because,every body part ,and ailment associated with the disability has a value.If your 40% indicates a settlement of say $40,000,then after a surgery you may be at 20% disability,which might even make you more employable,thus your settlement may be greatly reduced.Add to that,your SSDI may then become questionable.This is just a scenario ,no expert here,but I have always taken the advice of the person I hired to help me through my affairs regarding my disability ,my Attorney.Lastly,you mention in one of your posts regarding lifetime benefits.Its not a guarentee you will collect either for life.SSDI does reviews and W/C has the right to send for reviews as well.W/C is a very hard benefit to win for life and they like to close cases,so they don't go away as asy as SSDI.The at time use investigators to disprove cases.
