Does anyone know where I can check to see what happens to my ssdi if I settle my wc claim? my attorney is of no help I can't even get them to answer any questions and I'm worried about trying to find a different attorney after 10 years and now i'm getting scared. cause my wc is working with my back doctor to force me into surgery within 30 days please help

I called the Social Security Administation and was told that I had to notify them when I received my settlement, keep receipts for the money I spend, then they would suspend my monthly benefit (I'm allowed to keep no more than $2,000.00) then when I've spent the settlement to let them know and they will reinstate my SSDI benefits without having to go through the whole process again. It all depends on what type of settlement you are talkng about. There are 3 types of settlements, secured settlement annuity, lump sum cash, and the combination of a secured settlement annuity and a lump sum cash together.
Your settlement type will depend on the settlement amount offereddue to your specific injuries and ailments, what WC calls damage control.
Would need to know more to get specific, but if your payments stay under $250.00 a week then it will not affect you losing your SSID payments. Also, if you get a larger settlement, there may be what the SSA calls an "Offset Account" this is where the SSID decides how much of your settlement monies will be so called set asside in a special account with a seperate agency. These funds are to be used by Medicare to pay for your WC injury related visits and such. Medicare does not touch anything that is WC related.
My advice is if you decide to settle, whatever you do, "DO NOT WAIVE YOUR MEDICAL FOR LIFE!" WC will do everything for you to waive that medical but you never know what unforseen medical emergencies may pop up in the future.
Also, just like everyone else whom does not get the medical for life, this will make you pay a supplemental insurance company for extra fees not covered by Medicare unless you are a VA.
Do not be haste before you have checked out evry possible senerio.
