If you are in law enforcement, I appologise and do not mean to offend you!
The county that I am having so much trouble with keeps giving me more things to be angry about!
I posted about my son and his stup0idity that got him in trouble but the deputy was also not using his head. My son was pulled over for not having his lights on, Like he should never have done he tried to outrun the cop. A deputy sherrif set up a road block on an icy street my son tried to slam on his brakes to avoid hitting the car, then the deputy stepped in between both cars and my son's car bounced back and hit the deputy. I do not dispute that my son was wrong but the Deputy shot at his head, shooting to kill him. He only missed his head by 6 inches.

In court the Judge said that to him it did not look to him that it was an intentional act. He served 6 months in County Jail and then was sentenced to 6 months in a work ethics camp. He is doing great there. He even got 2 weeks knocked off for good behavior. He seems to not mind being there, of course he would rather be home with his daughter and family. I will say that he has learned his lesson.

The newest thing is that when I called the insurance company to see why insurance did not pain for the damage to the deputies car and the ER visit by the deputy. The insurance company said nothing had ever been filed. I called and talked to a sargent at the police department, he told me that an accident report was never filed because they thought it was an intentional act!!!! The total bill is 10,000 dollars now I don't have that kind of money and neither does he.

I am so afraid that they will deem it an intentional act even though the Judge did not see it that way after veiwing the video of what happened. Also the probation officer told me that I would need to start paying on his fine or his probation will be revoked! So herwe I am struggling to pay Dr, hospital and medication bills. They expect me to pay when I am barely getting by, yet I do not want my son's probation to be revoked when he is doing so good and will be home in the middle of December.

How do I become an activist against the system?? mOr what do I do to rid my self of this anger. The only person it is hurting is me! The police and Sherrifs Department don't care as long as they get their money. I just don't understand why a police report was not written up and how can they be so biased. A federal investigation had to be done since a deputy fired his gun. He was missing 2 bullitts, one of them he has no idea what happened to it???? He alsop does not remember shooting at my son. Now that is someone I wouldn't want to meet in a dark alley and he is supposed to serve and protect. None that happens in this county!!!!

Sorry for the vent, I just needed to get some of this off of my chest!
Thanks, Javisi

OMG Laurie this is the last thing you need! Well I've said before how horrific my own experience was in Nebraska many years ago! I just about went crazy from the different DA's,judges, etc. They seem to be living in their own world!

But about your situation: can you contact the feds? How about the state Attorney General's office? I also cannot believe that an accident report was never filed! And I also think your son's sentence was far too harsh. This is just adding insult to injury!

$10 grand for what exactly???? This is NOT your responsibility! The PO is pulling a fast one in my opinion! How much was the fine? I've got a question for you so will send a PM. There's most definitely an area of your state where crooks rule! I know from my own experience.....

Hope somebody else has some ideas, this is just not right!

The deputy's hospitalization costs should have been covered by his employer's medical insurance. I have never heard of an agency going after the parent of a violator to collect medical costs. As soon as you can, get a lawyer. DO NOT trust any state or county agency as a source of helpful, unbiased information. Get a lawyer that will work for you.

Pkcuffs,
Thank y6ou so much for the info! I am not as angry as I was initially but I am so frustrated. I have never been in trouble with the law before but if this is the way the system works, I would not have tried to teach my children to respect the police and their authority.

So much of this event has been rediculas! I do not beleive that it is this way with all law enforcement agencies but I do this one! My son is 23, but I am still paying the medical bills every month out of my Social Security check, Like I have so much money coming in every month! If I don't pay it, they say that his probation will be revoked. Forget about his dad paying anything, he is a total deadbeat dad!

I wonder how much money that they have gotten paid bt their insurance and from me and now they will eventually get paid by his insurance company. What a way for a police/sherrifs office to work. I guess they scam just like many6 other people. I just find it sad!

Thanks again for all oif the support! Javi:)

Hi JAVISI,
I'm sorry for the anguish and worry you have had to go thru over your son. It's a nightmare for any parent to have to live with these kinds of things. I normally don't like to get into this kind of post, but, being an ex-law enforcement officer, I think you need more information.

It is not the fault of your local police agency that you are having these problems. Your son, at the time of the accident, was fleeing and eluding, which in some states is a felony, and in some not. In any event, from your post, your son knew that the police wanted him to pull over. To not do so is fleening and eluding, along with other possible charges.

Just about every automobile policy in our country excludes coverage from any damages caused while the driver or policyholder is in the commision of a crime, which your son was. Even if a police report was filed by the local agency, the ins. co. would not have covered it. You may want to look at your son's policy, or even your own, to see the terms. This not only applies to an automobile policy, but to life, homeowners, and disability policies. In any event though, [B]you[B]are not responsible for payment of these damages. Your son is. He made the decision to run. You need to let [I]him[I]pay for his own mistakes. I know that you don't want to see him hurt, but if you take responsibility for all he does, he will never, ever, mature. It's hard, I know for a fact. But you need to stiffen.

As for you paying his costs of confinement or fines, I have never heard of such a thing. The court system cannot legally hold parents financially responsible for the sins of their children. Civil fees are different in some states. I would, as suggested, talk to an atty. to find out your exact responsibility in these matters. I think you are assuming too much of the cost, when it is not necessary. Good luck.

Bad COPS....NO donuts!
Hi Javisi dear...you've been thru too much!
There are agency's who help protect you from nightmare cops or situations gone bad...
I think you'd do well in contacting one of these agencies as well as an attorney who deals with criminal law.
I was a deputy Sheriff back in mid '70's...saw my share of bad cops, good ones as well. Was very hard for women in those days...was a struggle with both sexes!
I had a very bad run in with bad deputys 4 years ago...
we went all the way up the chain of command till we were vidicated.

The attorney will have the numbers of the agencies you're needing to contact.
I'm sorry you're having all this on your shoulders while you have so much with your health.
Oh...life on planet earth Merry-go-round...sometimes is just one bad ride!
I hope things begin to settle down where you'll have some peace so your body can heal.
Hugs, cheryl

Dear Friends,
I am hoping and even praying that insurance will cover some of this bill! My Lawyer says "do not pay it" But I am fearful of him being in violation of his probation. I know most parents say this but he is a good kid but he made a serious mistake, error in judgement! When we went to see him, when getting patted down. The guard even told me that he was a good kid!

It is going to be so hard for him to get on his feet due to all of the bills, he also has a child. She is 4 years old and her heart is breakling as well as his due to the inability to be with eachother. I know that she is his saving Grace! I beleive in my heart by his letters and his attitde that he is a changed person.

I tried to always teach my children to be respectful to the police! I know that their are good mpolice and bad police. I am not naive to that but The officer that shot at my son is a loose cannon. I am fearful of what will happen some day!

I keep hanging in there, he is going to gbe coming home in less than 30 days! I can't wait! Just a little update!

Being a biker, NOTHING and I mean nothing they do takes me by surprise. But, there are agencies and some VERY good lawyers out ther that just LOVE to make sure that the police getreminded the are there tp "protect and servre" Not shoot and ask questions lter. Or hassle and let the jedge settle it. I am not kidding on this one....years ago, we were out with a group of Norton Bike riders. They guys tok off for a ride(I had our daughter with uswho was still very young so I didn't get to go on the ride) He was having a bit of tech problems and stopped while the "pack" rode away. He was on the side of the road about 15-20 mins working on the bike (Brit bikes are notorious for breaking down) and a Cop drivesup..AND GET THIS...GIVES HIM A SPEEDING TICKET. Paparider had been at the side of the raod for about 15-20 minutes NOT MOVING.........can you believe that!!! Then the idiot cop wrote the name of his bike wrong, called it a FORODO, which is the kind of brakes he had on the bike. Hubby took it to court, seems the Jedge was a Norton Rider, and got a kick out of the story, gave a talking to the cop, and gave hubby his NOT GUILTY> LOL. We alway called that our fastest ike, it could get speeding tickets while not moving.

Get THYSELF A BIKER LAWYER--they LOVE to mess with the SYSTEM!!!!!:p :p

MamaRider,
I have been around bikes and bikers, went to stugis numerous times. I even rode my own bike from Nebraska to the southern tip of Arkansas. Now that was fun and a bit scarey. We had a lot of fun.

I never thought about getting a biker Lawyer, that is a good idea! Thanks. I can beleive that about the cops harrassing your husband! I have seen it many times .

Thanks for the support! I feel awfully alone at times and frustrated with the legal system. I guess I always will have a hard time forgiving the officer that shot at my son!

I am still Dreaming Big and Reaching for the Stars, Javi;)
