Does anybody know how long it takes, after a decision of fully favorable is made, to when they start your benefits? Or when you get your back pay?
The SSA told me to expect to get both in about 45-60 days, but pretty much everything they've told me is WRONG. And do they give the back pay in one check or do they divide it up? I have a friend who said her mother got hers in two separate checks a few months apart.
And also, I was told that I could possibly get dependent benefits for my daughter, and I should apply NOW, but when I asked the SSA about it, they said that I could not apply until MY benefits had already started.
And do they take taxes out of either SSDI or SSI? When I checked the website it said they only take taxes out if your yearly income is over $25,000 (or around there) or if you're married and file jointly, but I was told that that is wrong.
If anybody could give me some answers, I would appreciate it. I'm so confused!!

Hi Angel, I cant answer everything you asked but here goes..haha....
1. how long it takes depends on the backlog in your state and also if you have any other factors which have to be calculated before you get back pay such as workers comp or ssi, etc.
2.If its SSDI you should get your backpay in one check, if its SSI two checks , im not sure of the time period in between.
3. I applied for my children in my original application, and when I got the favorable decision went to the local office with their bank account information. I called first, and they told me when to come down.
4. As far as it being taxable it depends on the other income that you have or if filing jointly both have, and how large the back pay is. You can look up that informaiton online at the IRS site. There is a worksheet there which will give you a good idea of if it will be taxable.

OK, I just have one more question....
I read in one of the other posts that if you have a child and they were not listed in your original application that you should amend that right away. I'm not sure if my daughter is on my original...I think she is, but I'm not positive. I asked the SSA about filling out and application for dependent benefits, but they said I was not allowed to even fill out an app. until my benefits had already started...does that sound right?
And do dependent benefits get back pay?

Dependants do get back pay if you get back pay. YOur monthly amount also has to be a certain minimum for your child to get half of what you get. IM sorry I dont know the numbers off hand and Im really not feeling well enough to look them up right now....as far as when you can add them, it may very well be until after your benefits start, but I really dont know. I gave them the information after I got the fully favorable decision and they took it then and then applied it when the benefits started.

I think this is the link you were referring to in a previous post...If not let me know fallenangel....
To start recieving benefits: Every case is a bit different and it all depends on the back log...Keep in mind that the SSA system is changing over to a paperless system there are bound to be glitches..In my case, I received a bench decision, recieved a fully favorable letter 4 days later, just recieved my backpay a couple of days ago. My hearing was in the middle of Sept of this year. I should receive my first check this Wed.
The 2 seperate checks may have been SSI and not SSDI. SSDI comes in one lump sum while SSI comes in a couple of backpayments. Why, I have no clue why they do it that way.
Once you are approved, IF you did not put your kiddos on the original application call them to make an appointment to do so. Yes, you have to wait till you start getting paid because until you get your first check your folder could go to QA for review. About 7 out of 10 files go to QA while 99% of the fully favs go on to be paid out 1% are denied and go through the process again. Your fully fav letter should say, Your case may go through this process and SSA has 60 to do it...Once you get paid, you know your file didn't get pulled for QA...What is QA? A process where they make sure the judge did every thing correct...
Taxes...It depends on how much money you and your spouse make. Just make sure to put aside about 18% of your backpay just incase you have to pay taxes on it...Tax time is almost here and hey, if you didn't have to pay it you have some money put away that you can use on your medical or bills at that time...Yes, the 25,000 amount is way low...I believe they raised it to 95,000 combined..I need to double check that number...
I think I got them all, if not let me know what I missed...But yes, the 45-60 day wait period is about right...Mine was sent through fast because the judge requested it..I needed some much needed medical tests and didn't have the ready cash to get it done...He was very sensitive to me even though he was hard nosed with everyone else in the hearing room. If by the end of the 60 period you have not heard call your CR and ask them to pull your file up on the computer and tell you where your folder is. IF and I say If, your file was pulled for QA it will delay your payment another 60 days or so...You will recieve a letter in the mail if this happenes, SO if you have not received anything your good to go...
I know its hard waiting, I think once you get the approval, the wait for payment is harder than the years people wait just to get approved....I know it was for me....
