First question is the amount a persons monthly disability check calculated by the persons whole work history years or do they use like your highest earnings you had to calculate the amount you get.
Second question
Iam trying to figure out what my average current earnings (ace) number is.
I got hurt in 1998 and my highest wage in the 5 years before was in 1996 at 49,799.
so do i take the 49,799 divide it by 12 months=4149 then take 80 percent of that number which is 3319. would that be my ace number?
do i then take my workers comp monthly money and add that to my ssdi monthly money and if its lower then the 3319 i dont owe ss anything but if its over 3319 combined then ss has to reduce my money.
Am i calculating this right?
last question is, does ss have a max amount of ssdi money they will payout, no matter how much you were earning before you got injuried? and if so does anybody know roughly what the max amount was in 2000?
Thank you for any help anybody can give me with these questions as my lawyer is totally useless for answering questions.
