View Full Version : HIPAA violation now what?

I suffer from several mental health issues, including Post Traumatic Stress Disorder, Treatment resistant Depression and Impulse Control Disorder NOS. All of these stem from a lifetime of abuse. I was hospitalized in the behavioral health ward of a hospital last month. While I was there a sheet that the employees used to do their routine location checks was left where a patient found it. This sheet had the full name and diagnosis of every patient in the unit. The patient that found it proceeded to pass it around the "supervised" breakfast table. On this sheet I was incorrectly diagnosed as a borderline personality disorder patient, although neither the admitting psychiatrist or my psychiatrist had diagnosed me as such. Because borderlines tend to be very difficult to treat and many psych patients know this I was identified as "the sick one" by several of the patients. My self esteem was seriously compromised and I relapsed and self injured because of the humiliation. Do I have any regress at all against the violation of my privacy or the incorrect diagnosis? If HIPAA was violated what is the procedure I need to do to file a complaint? Thanks for your help Annmarie

yes, your hippa rights have been violated for that call a lawyer, from there they will know what to do.

now the other thing you were misdiagnosed, go to another doctor and get retested then you can dispute there dx ,,,


don't let them bully you..

Hi,

Just a little bit info, one of my doctors told me there is an automatic $50,000 fine or penalty.

I am not sure it will apply for you as you were at the doctors office, except if you could see it anyone could.

It's something to look into. I definitly would chew out the doc.
