i am clasified as permanant partial dissabled, by ny state, i i able to work but whithin my restrictions, light work, comp sent me a form to fill out putting down all my job searches well i did and sent it back to them , i get a partial check for life , and i am lucky i can still be able to work, but the problem is none of these applications for jobs are calling me back , they do a back ground check on you , someone told me workers compensation comes up on your back ground check is this true, if it is true my chances of getting a job id zero, i hope someone can verify this , its so frustrating i spend many hours looking and looking and not one call me back, please help :confused:

There are a number of national index services that some carriers pay to belong. It's subcription based so it's only available to those who pay.
It's illegal to discriminate based on the existence of a prior claim so you can pursue the matter legally.

i've encountered the same thing since looking for a job. don't let anyone tell you that employers won't hire you because of a WC claim because that is b.s. it may be illegal and immoral, but if you think they won't find some other reason besides you're WC claim, past or present, you live under a rock. been on this road for too long now and hate seeing others in the same prediciment. yes, all states WC laws are diffrent, but they are all twisted against the injured worker and for helping the employer:mad: i finally got a chance at Voc. Rehab. since my injuries have disabled me enough to be put on a Priority Category 2 list.....so maybe there is a glimmer of hope (not holding my breath though) maybe that could be an alternative for you to look into, although i'm in missouri and you're in n.y., they probably have simular programs available for you to apply to. good luck....you'll need it with the WC peeps!!!:eek:

I was told the same kind of story when I was going thru my W/C case.true they cant discriminate,but they do have the right not to hire ,period.They dont need to give a reason why you didn't get the job.As for filing a case,again,you NEED the PROOF you were denied because of your limitations,and employers know all to well NOT to use that as a reason.No atty. would touch it.Dont know what the poster did for work,but ,it is usually in your best interest to find a job through word of mouth contact and have some personal connection in the middle(a friend,family member )be a reference,rather than look for a job from the paper and such.

thanks guys it gives me some insight about the problem getting a job , i moved to north carolina big mistake, i have done nothing but look for jobs and go on interviews , all they say is they will contact me , yeah right?
i wait for calls that never come,
i am moving back to ny , first of all i thought the carolinas where a cheaper more affordable place to live again i say yeah right? nothings cheap here, and i know that if they find out you are on compensation you automatically become a liabilty for them , its hard to prove , its almost impossible to find out, so i,m moving back to ny maybe i will try again , and thanks again all you input helps me alot, we are not the bad guys here we are the victims , who suffer a hell of a price when injured thanks

always glad to be of some help to another injured worker......we all have wayyyyyy too many problems as it is, let alone trying to keep from getting screwed everytime we turn around by the IC or WC system!!

One of my biggest mistakes was moving from the state in which I got injured at and back home to where my family was at......little did I know I would give up ALL my worker's comp rights when I did that......*temper tantrum......there should be a LAW against that....the worker's comp in the state I was injured at didn't seem very helpful anyway, to begin with....I felt all alone and didn't know anybody (except my employer) so I moved.
Voch Rehab refused to help me stating I needed to come back when I no longer had back problems (what a joke)....Voch Rehab has been worthless to me....yet they have said I need social security.
Everybody says I need it except social security....TOO!
All the beauracratic runaround is disgusting, even DHS doesn't do their darn job right...........they tell me I need social security then put me in the back ofthe line for other services, don't want to do anything for me at all........
I am just angry now....
urghhhh.
I am SOO TIRD OF THE bearacratic runaound from EVERYBODY!!!

Just a idea. Have you thought about starting your own business. Possibly something with your computer perhaps.That way Nobody can tell you what to do or say like We are not HIRING TODAY.I only wish you well. I am also on WC and SSDI. I am totaly permantly disabled and can imagine just how you feel.
