View Full Version : Almost 6 yrs ( I think) and STILL waiting

If I remember right.. I applied for SSI/SSDI in Dec of 2000 and have been thru all the denials. I have been thru 2 court hearings. Both judges denied me even without really taking into consideration ALL of my disabilities. Now we are in appeals proccess again.

The last one (judge) even seem to almost jump at me from across the table when I told him I couldnt even clean my house.. He said WHY CANT YOU CLEAN YOUR HOUSE? I told him because of pain.. I cant even stand long enough to do a sink of dishes.. I even had my walker with me because of pain and balance issues.

NOW I even have a powerchair if Im not using my walker. It took HIM a YEAR to send us the denial. :eek: :mad:

Since then my health has gotten even worse..

This is a list of my medical conditions most I've had SINCE the hearings tho I know not ALL of them are disablying but they are what are on my medical records...

1. BCCNS - Basal Cell Carcinoma Nevus Syndrome (Gorlin Syndrome)
2. Chronic (severe) GERD - Short segments Barretts
3. Asthma
4. DDD (Degenerative Disc Disease) in cervical, thoracic and lumbar
5. Allergies
6. Hypothyroidism
7. Spina Bifida Occulta - cervical and lumbar
8. Depression
9. Balance Disorder
10. Lumbosacr spondylolysis
11. General Osteoarthrosis
12. IBS
13. Other bowel disorders also - similiar to dumping
14. Migraines and other headaches
15. Scoliosis, Kyphosis, Lordosis
16. Bladder incontinence
17. Sleep apnea
18. Neurological - Right sided weakness, memory problems, balance, comprehension, itching, swallowing, fuzzy vision
19. Athletes feet
20. Obesity
21. Obstructive Lung Disease - get bronchitis and pnuemonia easily and frequent
22. Mild (low normal) hearing loss in right ear and always feeling "plugged"
23. Implants in ankles for arches
24. Skin Cancer
25. Herniated discs
26. Seizures
27. Ataxia
28. Arthritis
29. Bowel incontinence
30. Peripherial Neuropathy (hands and feet)


Yet Judges say I can work.. Let HIM spend a day in my shoes..

Demerol 100mg
Fentanyl Patches 50mcg/hr
Celebrex 200 mg
Oxycodone w/APAP (Percocet) 5/325
Maxalt-MLT 10 mg
Motrin 800mgs
Relpax 40 mgs

I guess I was lucky I got right on Social Security disability. You need a doctor to go to bat for you and say you need it. A lawyer probably wouldn't hurt either. Good luck.

Good God you should have been approved the first time out.
It just isn't right. Have you inquired to your Congressman about helping? Do you have an Attorney?

When I was going through the appeals process I called my congressman's office and asked them for help. With their help and my Attorney's help as well I was able to get approved with an on the record decision from the judge. I didn't have to have a hearing as the judge awarded me benefits based on the medical records I had.

I never thought I would get it either and if I had not obtain the assistance of my congressman and my lawyer I don't think I ever would have.

yes I've had an attorney since before my first hearing. Even during the hearing she told the judge that with my incontinence that I would have accidents and would have to go home from a job and have to shower and change and that wouldnt be possibly with a job along with my other disabilities.. He didnt even consider it.

I considered calling the congressman/woman.. hey.. I could call the TERMINATER. lol We have him as our governater. I mean govenor. ;) The attorney said that my county has 3 of the MOST HARD NOSED judges and the hardest to approve disability. :(

I just got my Fully Fav, Not to long ago ---March 2006....After the ALJ court denied me my benefits....Now what I don't understand is......I never had to go back to court again per seee....The ferderal goverment kind of took over my case.....They were the ones that granted me my fully fav...They said , that the ALJ had NO right to denie me in the first place....And gave me the fully fav all the way back the 5 years...The day I went into the Hospital (not the day I called that was in sept,,but they went all the way back to Jan 2001 )

Now why haven't the GOV..done that for you..I tell you, I'm from OHIO and I had a hard nosed ALJ DUDE !!!! But they took care of me ( It took them 2 more years ) but it did happen....They even paid my lawyer extra monies.Allmost 3 thousand dollars...Gave me back my 250 filing fee...I was Disabled with disabling pain due to inoperable brain aneurysm..HUgs, Cindy

I think I remember reading your posts about going thru it all. I am sooooo glad you finally got approved. :) I'm sorry for my forgetfulness.. and it doesnt show signatures on here while replying.. but were they ever able to remove your anyrism? or is it still in there?

I still have it...It's too deep in the brain..At this point any kind of surgery that is out there now, Will kill me,, So i live with it, In hopes that one day. Someone will come up with someway to fix it..Thanks for asking..I will be praying for you, Hugs, Cindy

heh i am in the same situation. but mine is more due to incompant lawyers. but i been going over 6 years (i think heh).

I have a congrasmen and senator calling and writing about my case. we are at the 2nd adj hearing (well waiting for a court date).

my lawyer said if we do not win this time we may be done. something about the lengh of time from when the disablity first happened.

This is not right. The judge's are abusing their discretion. I am on disability and had a food stamps 'worker' who used to all the time deny that I was disabled because just by glancing at me, it did not always show. She accused me of being a fraud and this went on for years as she was m 'worker'. It was very hard to cope with. She would shove a paper in my face about food stamp fraud every time I went there. It hurt alot. I am really hurting for you by reading this. However I have heard of similar stories. But that does not help you any. Your friend, Julie

I suppose I'm one of the few on here that have been approved almost
immediately after applying for SSDI. However, that's the only good thing
I can say about it.

I worked at my last job for a little over 5 years. Then, my position was
eliminated and they tried to put me in housekeeping (middle shift). Since
I don't drive, I wasn't able to take the position. To make a long story
short, I've been on SSDI since '98. It started out as being a little over
$500 a month and now it's a little over $600 a month.:rolleyes:

I can't even afford Medicare Part B, so I'm on my father's insurance
as a "disabled dependent". Needless to say, I can't afford a place to
live, either. Which is why I'm still living with my parents.

When is Social Security going to realize that we can't live off of the
piddling "allowance" they give us? And that medical conditions cost
money, beyond the so-called "cost of living"?!

All I hear about is better Soc. Security and Medicare benefits for
seniors. What about those of us under the age of 65, who are
unable to work due to medical conditions?! Don't we count?!:mad:

Since I haven't seen you on the board in so long, I thought you had been approved and moved on.

I'm sure sorry to hear that you are still fighting with them. DO call your congress person. Sometimes it helps. And document, document, document. Keep a daily journal. Get a copy of every doctors visit, every little detail you can.

You know the routine from being on here. I wish I could offer you some more advice. Good luck with your case. Maybe you need a new lawyer. I would only hire someone that has years of experience in this kind of law.

Let me hear from you on this. I care and I do know what you are going through. It took mine 18 months nearly to the day, but I did get it. I had to fight like **** but Liam gave me very good advice on here and I did everything he told me to do, so if he is still around try asking his advice.

I was approved in '98. My problem is that it's not enough money to be
able to afford a place of my own. Which is why I'm still stuck in my
parents' house. Another thing I can't afford is Medicare Part B. I only
get $600+ a month and Part Bis $90 a month. Plus all my other monthly
bills, of course.:rolleyes:

go to your local welfare office, you might get some kind of help, but i doubt it. im sorry, i know how you feel, it bad anough stressing out about "to much month at the end of the check" , much less if social security slap a CDR on person if they try moonlite an make a lil'coin now an then. its bad as it is worry about the ordinary CDR's, ... but they like sharks smelling blood you try make a buck here an there, like they keep a person down an hungrey to encourge them try earn extra buck when tired of ramon noodles . LOL .
