Hey guys...., am I missing something here? Go to this forum and tell what you think. My screen name is "ItzJustMe" over there. I just think that most of the "Big Gun" posters GAVE the wrong info to the original poster who was asking for help. I'm not picking a fight over there----I'm just trying to show what should have been for the poor fellow.

Wink ol buddy.Without any doubt,your right,the guy cannot be forced to work by an employer after a w/c dr.has taken himoff work. But what I have found in some of these "FREE LAW ADVICE??)furums,is there are indeed tONS of blowhards.Think about it,some of these clowns have tens of thousands of replies.Do they not have anything else to do.Many are just there for confrontation.I was looking for some advice on the Free advice forum.I got to tell ya,I never had such an assanation of my character by anyone,no less people that didn't know me,I was looking for some genuine help,yet I was accused of cheating system,sanbagging etc.I go there from time to time just to find some lost sheep and send them HERE.You ask a realestate question and the same butthead that claims to be a divorce lawyer hits you with not only wrong info.but info.that could further hurt you. My advice,stay here for solid comfort,I have seen blowhards shutdown here,whereas on the other sites ,they are seen as idols,by their wanna be followers.That person in question should have been told ,NUMBER 1,get a lawyer.yesterday,and post over here.Hope your doing OK.I am doing better these days. I finally had my hearing for SSDI and got it.I'm awaiting my first check and my almost 4 years of backpay.Talk about taking the pressure off.Good luck to you,AND don't get suckered into meaning less fights on those sites that do NOTHING for YOU.

i just read the whole thing, the injured employee did return to work voluntarily. you have to know your rights, and also realize that even though the law is on your side you still may be terminated. best bet in situations like that is fax the doctors note over, never go there in person, if your told to not work, try and not go near the place. the problem is unless you have a union protecting you in many states the employer can terminate you if you cant work due to a work injury. they are still responsible for the wc claim, but they don have to keep you employed.

i just was looking over all the advice the pets gave for wc ny, about all incorrect or incomplete , when i try and correct they war with me, the cbj moderator and ellemd want to be the only ones to give advice, and they feel that there input carries more weight then anyone else's.
they are wrong on so many questions.
however they dont want anyone else to give input.

the problem with the wc laws , even though the worker may have the laws behind them in a case like this, there is no penalty for the employer to disregard the law. a lawyer in ny mentioned this, he had taken a case years ago for illegal firing due to wc claim, it was a money loser, since even though they could prove the case, there is no fine or payment to the worker, whereas if you lose your arm or leg, there is a line item and price attached to it.
i agree the person who posted was very short and frequently gives incorrect advice and plain bad advice. however if the injured worker doesn't have the balls to walk away , when the boss says work or be fired , i doubt they have the balls to follow through on a lawyer hunt . sometine it is not a good idea to fight for those rights if it means losing your job and no chance of winning a case that will pay the injured worker
in nys the injured worked has the right to videotape the ime, it even states this on the IME notice, i have heard of people going there with a camera, being told they cant videotape and taking that at value and not walking out. then they complain how bad the ime doctor was and how unprofessional the place was.
be interesting if a lawyer in the state it happened in would be willing to take on Case for wrongful termination if it happens again

yeah i got a warning notive today i will be banned due to my diruptive behaviour. the modertors there are pure management biase. they shouldnt have a wc forum over there they spew out tootally incorrect info and if you try and question it they remove your posts and lock the thread.

i feel sorry for the injured worker that listens to any of the b.s. that is spewed from that site...ElleMD is purely for the insurance company and the employer.....not for the employee. did you happen to see all the crap she/he has put on that forum? not just the workmans comp forum iether... a regular freeeeeekin' walkin' encyclopidia of mis-information!!!!!!!!!!:eek: :eek: :eek: :eek: :eek: :eek: :eek: :eek: :eek:

yeah ellemd really spews out a lot of totally incorrect info, very dangerous to the readers that don't realize she is wrong in most of her statements.
that would be ok in many forums, since there is normally a discussion allowed , where other posters can dispute the info and offer the correct info. however in that law talk forum it is not allowed. forums are great for knowledge where there is open exchange of information, but in these law talk forums they only allow one or two persons input. i am going to go thru the list of postings and copy all their incorrect postings and pm it to the form owner, tom, he needs to be informed of the poor moderators over there.

yep.it's amazing that people can be so evil. Heres a person that needs direction and someone is pointing them in the wrong direction.As I posted,thefreeadvice forums are just as bad if not worse.There .they are giving advice about divorce,w/c real estate,just about everything to do with legal.I posted a few times about my real life experiences that cost me thousands.The replies were rude,insulting,insinuating I was wrong and had no law experience as I was NOT a lawyer,the rules of the forum allow people with experience to post.Totally blew my socks off.I went there when this site had its problems last yr.Im sooooooooo glad it came back.

findlaw has some state specific wc sites where a practicing wc lawyer for the state answer questions, it is excellent for ny state.

they ban all who oppose them at laborlawtalk.com. they are a bunch of idiots, so far they have no response to the question i have posted, and they always have some response (mostly against the injured employee or you have to just bend over and take it from the insurance companies)

i'm done with that site. i just couldn't stand to see anymore injured workers get SOOOOOOOO much bad and incorrect advice, so i told them "see ya's" hopfully some of those i sent a link to will come here and find
GOOD advice to help them with their fights. WE ALL HAVE ENOUGH CRAP TO PUT UP WITH GOING THROUGH WORKER'S COMP. TO BEGIN WITH!!!!!!!!

i think it is better to keep an eye on them and post the info of good wc sites. keep spreading the word on how bad they are as not letting other posters post better information

there are about 7 states that have their own forums, those have a wc lawyer that actually answer questions, the ny one is great.
the way they dispense advice over there is bordering on illegal, since they ban anyone that try to give correct information and remove their posts, they are basically given legal advice without a license, which is illegal in nys.

yeps.....done spoke with the attorney from st. louis and he knows my lawyer! said we're on the right track, and the miniscule amount the IC through out there isn't even close to what i should be compensated. at least we're on getting closer to making them pay for the b.s. i have been and still am going through.

I got to admit something here. When I find those kind of idiots your tlking about. I kinda enjoy putting them on and get them to lose their minds.All I got is time.After getting bad info from some of the fools ,I go back and get em to pull their heads outa the sand.You can almost guess which one is going to respond.

i guess ol' cgb didn't like me setting ElleMD staight today. lol o'well.......she just couldn't keep her facts straight when confronted by someone who knows how the system works.:eek: am going to miss watching GaOvertimeLawyer and really hope some of those that i chatted with will hopefully come here and get some help from those who have been there-done it as an injured employee. so much hurtful and untrue crap came out of so many who haven't a clue or just don't care for the employee.:mad:
